This award follows the dismissal in March of a copyright infringement lawsuit filed against Carey.
The lawsuit centered on Stone's allegation that Carey's iconic song, "All I Want For Christmas is You," was a copy of a 1988 Christmas tune by his band, Vince Vance & the Valiants. Stone had sought $20 million in damages when he initiated the legal action in November 2023. However, Judge Mónica Ramírez Almadani ultimately found that Stone and his co-writer, Troy Powers, failed to provide adequate proof of infringement. The court's ruling also sharply criticized the "egregious" behavior of Stone's attorneys, Gerard Fox and Douglas M. Schmidt. The dismissal documents highlighted that while individual instances of misconduct might not seem severe, their collective nature warranted substantial penalties.
The court determined that Carey, along with co-defendants Sony Music, Kobalt Publishing, and producer Walter Afanasieff, incurred unnecessary costs due to the plaintiff's "frivolous legal arguments and unsupported factual contentions." The total sanctions imposed amounted to $109,983, with Carey receiving the largest portion. The judge also raised concerns about the plaintiff's legal team's professional duties, noting their apparent failure to represent the interests of co-plaintiff Powers. Fox and Schmidt have until January 5 to justify their actions, with potential additional sanctions looming if they fail to comply.
